PSC and RTI Act

I applied to the Kerala PSC for a copy of my answer paper as per the Right To Information Act (RTI Act), but the PSC replied me that they can give the copy of my answer paper only if I apply before 45 days of the examination. Is it a responsible reply ? Can I go for further legal actions against Kerala PSC ?

PSC is always under the purview of RTI Act , as per the judgement of Supreme Court in a case Bihar PSC Vs Abbas Rizwi. As per the judgement PSC is required to give copies of answer sheets of the examinations (It can hide the valuers name and details in the answer sheet). The Kerala PSC's stand of 45 days time is not supported by any Act and you can always give petition to State RTI Commission against the reply you got from the PSC office.
